Waste Removal Wembley Service Terms and Conditions
These Terms and Conditions set out the basis on which Waste Removal Wembley provides waste removal, rubbish collection and related services to domestic and commercial customers. By booking any service with us, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and Waste Removal Wembley.
1. Definitions and Interpretation
In these Terms and Conditions, the following expressions have the following meanings:
Customer means the person, business or organisation requesting and paying for the services.
Services means waste removal, rubbish collection, clearance, loading, transportation and disposal services provided by Waste Removal Wembley, together with any ancillary services expressly agreed in writing.
Waste means any items, materials, rubbish, junk or refuse that the Customer asks us to remove, subject to legal and regulatory restrictions.
Contract means the agreement between Waste Removal Wembley and the Customer comprising these Terms and Conditions and the confirmed booking details.
2. Service Area and Scope of Services
Waste Removal Wembley offers a range of waste collection and removal services in Wembley and surrounding areas. Our services may include household rubbish clearance, garden waste removal, office and commercial waste collection, light construction and refurbishment waste removal, and bulky item collection, subject to availability and regulatory requirements.
The exact nature and scope of the services to be provided in any instance will be as agreed at the time of booking and confirmed in our booking confirmation. We reserve the right to decline or amend any booking request that falls outside our normal operational capability or legal permissions.
3. Booking Process
3.1 Booking Request
You may request a booking by telephone, email or through any other booking method we make available. At the time of booking, you must provide accurate information about:
the collection address and any access restrictions
the type and approximate quantity or volume of waste
any potentially hazardous or unusual items
your preferred date and time for collection.
3.2 Booking Confirmation
A booking is only confirmed when we have accepted your request and provided you with a booking confirmation, which may be by email, text message or verbal confirmation over the phone. The Contract between you and Waste Removal Wembley is formed at the point of confirmation.
3.3 Changes to Bookings
If you wish to change the date, time, location or scope of the services after booking, you must contact us as soon as possible. Any changes are subject to our approval and availability, and may result in a revised quotation. We are not obliged to accommodate changes requested at short notice, and normal cancellation charges may apply.
4. Quotations and Pricing
4.1 Quotations
Any quotation provided before the collection is based on the information you supply about the waste to be collected. Quotations are normally given as a fixed price or as a price range depending on the estimated volume or weight of waste and the level of labour required.
4.2 Price Adjustments
We reserve the right to adjust the price on arrival if:
the actual volume, weight or nature of the waste differs from that described at the time of booking
there are additional items not previously declared
access is significantly more difficult than described or requires additional labour or time
there are additional services requested on site.
If the adjusted price is not acceptable to you, you may decline the service. In such circumstances, we reserve the right to charge a call-out or cancellation fee to cover our costs.
4.3 VAT and Other Charges
All prices will be stated inclusive or exclusive of VAT as applicable under current UK law. Any additional charges, such as charges for specialist disposal of certain items, congestion charges or parking costs, will be communicated to you where reasonably foreseeable.
5. Payments and Invoicing
5.1 Payment Terms
Unless otherwise agreed in writing, payment is due in full on completion of the service at the collection address. We may request a deposit or full prepayment at the time of booking for certain jobs or for new commercial customers.
5.2 Payment Methods
We accept common payment methods such as cash, bank transfer and major debit or credit cards, subject to availability at the time of service. Details of accepted payment methods will be confirmed when you book.
5.3 Overdue Payments
If payment is not made when due, we reserve the right to charge interest on overdue amounts at the statutory rate applicable to business-to-business or business-to-consumer transactions, as relevant, together with any reasonable debt recovery costs. We may suspend or cancel further services until all outstanding sums are paid in full.
6. Cancellations and Rescheduling
6.1 Customer Cancellations
You may cancel a booking by giving us notice by telephone or email. The following charges may apply:
cancellation more than 24 hours before the agreed arrival window: no cancellation fee
cancellation within 24 hours of the agreed arrival window: we reserve the right to charge a reasonable cancellation fee to cover our costs and lost capacity
cancellation on arrival or failure to provide access: we may charge the full quoted amount or a substantial proportion of it.
6.2 Rescheduling
We will make reasonable efforts to reschedule your booking if you request a change more than 24 hours in advance, subject to availability. Repeated rescheduling or last-minute changes may incur additional charges.
6.3 Cancellations by Waste Removal Wembley
We may cancel or reschedule a booking at any time if affected by events outside our reasonable control, such as severe weather, traffic disruption, vehicle breakdown, staff illness, or safety or legal concerns. In such cases, we will seek to notify you as early as reasonably practicable and offer an alternative booking time. We will not be liable for any losses arising from such cancellation or rescheduling, other than refunding any sums paid in advance for services not performed.
7. Customer Obligations
7.1 Access and Parking
You must ensure that we have safe and reasonable access to the property and the waste to be collected. This includes arranging suitable parking for our vehicle where necessary, and ensuring any required permits or permissions are in place. If access or parking is not available or significantly restricted, we may need to adjust the price or, in some cases, may be unable to carry out the service.
7.2 Accurate Information
You are responsible for providing accurate and complete information about the waste and the working environment. If we discover that the waste includes items that are hazardous or prohibited, or that the nature of the work is substantially different from what was described, we may refuse to proceed, adjust the quotation, or require additional safety measures.
7.3 Presence on Site
For domestic customers, we normally require that an adult is present at the property during collection to grant access, confirm the waste to be removed and make payment. For commercial customers, an authorised representative must be available to provide instructions and authorise completion.
8. Waste Types and Prohibited Items
8.1 General Waste
We collect a wide variety of non-hazardous household, garden, office and light construction waste. All waste must be capable of being safely handled by our team and loaded into our vehicle.
8.2 Hazardous and Restricted Waste
Certain materials are classified as hazardous or controlled waste under UK law and may not be collected by us, or may only be collected under specific conditions and at additional cost. These items may include but are not limited to:
asbestos and asbestos-containing materials
clinical or medical waste, sharps or biological materials
industrial chemicals, solvents, oils or fuels
paint, varnish, adhesives and similar substances in liquid form
gas bottles, pressurised containers and certain batteries
electrical or electronic equipment in certain categories, depending on current regulations.
If you are unsure whether an item can be collected, you must contact us in advance. We reserve the right to refuse collection of any items we reasonably believe to be hazardous, illegal or unsafe to handle.
9. Compliance with Waste Regulations
9.1 Duty of Care
Waste Removal Wembley operates in accordance with applicable UK waste management legislation and guidance, including the duty of care requirements for waste carriers and waste transfer. We will transport and dispose of collected waste only at authorised facilities and will, where appropriate, seek to prioritise reuse and recycling.
9.2 Waste Transfer Notes
For commercial or construction waste, and in any other circumstances where required by law, we may issue or complete waste transfer documentation describing the type and quantity of waste collected and the method of disposal. You agree to provide any information reasonably required for such documentation.
9.3 Customer Legal Obligations
As the producer or holder of the waste, you have certain legal responsibilities under UK law, including a duty to ensure that your waste is transferred to an authorised carrier. By engaging Waste Removal Wembley, you confirm that you have the right to dispose of the waste, and that it does not include any materials whose disposal would breach environmental, health and safety or other regulations.
10. Liability and Limitations
10.1 Our Responsibility
We will provide the services with reasonable care and skill, using competent staff and appropriate equipment. If we fail to do so, we may, at our option, re-perform the services or offer a partial or full refund for the affected part of the services, subject to the limitations set out in this section.
10.2 Exclusions of Liability
We will not be liable for:
any loss or damage arising from your failure to provide accurate information, adequate access or a safe working environment
indirect or consequential losses, including loss of profit, revenue, business or opportunity
any damage to items that you have asked us to remove where such items are already in poor, fragile or unsafe condition.
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
10.3 Customer Responsibility for Property
You are responsible for ensuring that any items not intended for removal are clearly separated or identified. We accept no liability for items mistakenly presented as waste or left in bags, boxes or containers with waste, unless such loss arises directly from our negligence and could reasonably have been avoided.
11. Complaints and Disputes
11.1 Complaints Procedure
If you are not satisfied with our services, you should contact us as soon as possible, providing your booking details and a clear description of your concerns. We will investigate and respond within a reasonable timeframe, and may request further information or evidence.
11.2 Resolution
We aim to resolve complaints amicably. Where appropriate, we may offer to re-perform part of the service, provide a partial refund, or make another reasonable gesture in full and final settlement of the matter.
12. Data Protection and Privacy
We collect and process personal data such as your name, contact details, address and payment information for the purposes of managing bookings, providing services and meeting our legal obligations. We will handle your information in accordance with applicable UK data protection laws and only retain it for as long as necessary for these purposes or as required by law.
13. Amendments to These Terms
Waste Removal Wembley may update or amend these Terms and Conditions from time to time to reflect changes in law, regulatory requirements or our business practices. The version in force at the time of your booking will apply to your Contract. We recommend that you review these terms periodically when using our services.
14. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
You and Waste Removal Wembley agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided.
By booking a waste collection or removal service with Waste Removal Wembley, you confirm that you have read, understood and agree to these Terms and Conditions.
